These Terms & Conditions (“Terms”) govern your use of the Kelly Gibson Foundation website and any forms, information, or services made available through it.
The Kelly Gibson Foundation (“KGF,” “Foundation,” “we,” “us,” or “our”) is a Louisiana nonprofit organization. By accessing or using our website, you agree to these Terms. If you do not agree with these Terms, please do not use the website.
1. Website Use
The KGF website is provided primarily for informational purposes and to provide access to information about our charitable programs, golf tournaments, scholarships, fundraising events, donations, and other Foundation activities.
You agree to use the website only for lawful purposes and not to interfere with its operation, security, or accessibility.
KGF may modify, suspend, or discontinue any portion of the website at any time.
2. Programs, Events and Tournament Registrations
KGF administers golf tournaments, charitable events, scholarship programs, and other activities. Registration or participation in these programs may be subject to additional eligibility requirements, registration terms, waivers, rules, deadlines, cancellation policies, and other conditions specific to the applicable program or event.
Where event-specific terms or policies differ from these Terms, the terms provided for that particular event or program will control.
KGF reserves the right to modify schedules, dates, locations, formats, eligibility requirements, fields, activities, or other aspects of its programs and events when reasonably necessary. Events may also be postponed, relocated, rescheduled, modified, or canceled because of weather, course conditions, safety concerns, circumstances beyond KGF's control, or other operational considerations.
Refund and cancellation policies may vary by event and will be governed by the policy communicated for the applicable event or registration.
3. Participant Waivers
Participation in KGF golf tournaments and certain other activities may require participants, or a parent or legal guardian when applicable, to agree to a separate participant waiver, release, or other terms as part of the registration process.
These Terms do not replace or modify any separately executed participant waiver, release, registration agreement, or event-specific terms.
4. Scholarships
KGF administers multiple scholarship programs with different purposes, eligibility requirements, application procedures, deadlines, selection criteria, and award conditions.
Each scholarship program is governed by the requirements and rules published or communicated for that particular program. Submission of an application does not guarantee eligibility, selection, or receipt of an award.
KGF reserves the right to verify information submitted in connection with a scholarship application and to administer its scholarship programs consistent with applicable program requirements.
Information submitted through scholarship applications is also subject to our Privacy Policy.
5. Donations
KGF's website may provide links directing visitors to third-party platforms used to process charitable donations. KGF does not process donation transactions directly through this website.
Unless otherwise required by law or expressly agreed by KGF, charitable donations are nonrefundable. If you believe a donation was made in error or a duplicate transaction occurred, please contact KGF so that we may review the circumstances.
Third-party donation and payment platforms may maintain their own terms, conditions, and privacy practices. Your use of those services is also subject to the applicable provider's terms and policies.
6. Third-Party Services and Links
KGF uses or links to third-party services in connection with its programs and operations, which may include services for tournament registration, donations, email communications, website functionality, and other organizational activities.
For example, certain tournament registration and administration services may be provided through BlueGolf, while other services may be provided through separate third-party platforms.
KGF does not control independently operated third-party websites or services and is not responsible for their content, availability, security, terms, or privacy practices. A link to a third-party website does not necessarily constitute KGF's endorsement of that website or all content available through it.
7. Intellectual Property
Unless otherwise indicated, the content appearing on the KGF website—including text, graphics, logos, photographs, videos, designs, event materials, and other content—is owned by or licensed to KGF and is protected by applicable intellectual property laws.
You may view, download, or print website materials for personal, noncommercial use. You may not reproduce, distribute, modify, publish, sell, commercially exploit, or otherwise use KGF content without prior written permission from the Foundation, except as permitted by law.
Names, logos, trademarks, photographs, and other materials belonging to sponsors, partners, service providers, or other third parties remain the property of their respective owners.
8. Photographs, Results and Program Information
KGF may publish tournament results, participant achievements, scholarship awards, photographs, videos, event information, and other program-related content through its website and other Foundation communications.
The collection and use of personal information, including information relating to junior participants and scholarship applicants, is addressed in our Privacy Policy and, where applicable, participant registration materials and waivers.
9. Website Submissions
When submitting information through a website form, scholarship application, contact form, or other Foundation communication, you agree to provide information that is accurate to the best of your knowledge.
You may not knowingly submit false, fraudulent, unlawful, or misleading information or use Foundation forms or systems for unauthorized purposes.
Submission of information through the website does not create a contractual, employment, scholarship, donor, or other relationship with KGF unless separately established in writing.
10. Privacy
Your use of the website is also subject to the Kelly Gibson Foundation Privacy Policy, which describes how KGF collects, uses, shares, and protects personal information.
11. Website Information and Disclaimer
KGF strives to provide accurate and current information but does not guarantee that all website content will always be complete, accurate, or current. Information regarding events, programs, schedules, scholarships, and other activities may change.
The website and its content are provided on an “as is” and “as available” basis to the extent permitted by applicable law.
KGF does not warrant that the website will operate without interruption or error or that all website content will be free from technical issues, viruses, or other harmful components.
12. Limitation of Liability
To the fullest extent permitted by applicable law, the Kelly Gibson Foundation, and its directors, officers, employees, volunteers, and representatives will not be liable for indirect, incidental, special, consequential, or similar damages arising from or relating to use of, or inability to use, the website.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.
Separate waivers, releases, agreements, or other terms applicable to participation in KGF events or programs may contain additional provisions regarding liability and risk.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Kelly Gibson Foundation, and its directors, officers, employees, volunteers, and representatives from claims, damages, liabilities, or expenses arising from your unlawful use of the website, your violation of these Terms, or your infringement of the rights of another person or entity.
14. Governing Law
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.
To the extent permitted by applicable law, any legal proceeding arising from these Terms or use of the KGF website shall be brought in a court of competent jurisdiction in St. Tammany Parish, Louisiana.
15. Changes to These Terms
KGF may update these Terms periodically to reflect changes in our website, programs, operations, or legal requirements.
Updated Terms will be posted on our website with a revised effective date. Continued use of the website following an update constitutes acceptance of the revised Terms to the extent permitted by law.
